Making A Purchase
To purchase any software application from this website, simply add the required items to the shopping cart and proceed through the checkout process. On completion of checkout, you will receive an email confirmation of your order and if your payment method was validated, you will be contacted shortly afterwards (usually the same business day) with instructions on how to either upgrade your free trial or download and install the purchased software, as applicable.
When confirmation of your order is received, this is to indicate that we have received your order. It does not indicate that a contract exists between us. We will indicate acceptance of your order, and hence a contract between us, when we supply you with the Activation code for your software and/or subsequently contact you to confirm your order was successful. We have included this term to protect us in the case that a mistake has been made in pricing, we have inadvertently under-priced goods, or we are no longer able to supply a particular product for some reason. In the case of a change of price, we will always contact you first to ensure that the price is acceptable.
If you have made a mistake in your order and cannot correct it in the shopping cart, contact us and we will correct the mistake.
Payment Options: We accept Paypal. major credit card or direct bank transfer payments. For Paypal and card payment customers shopping from outside the UK, place your order and your card company will convert the transaction to your own currency. If you prefer to pay by direct bank transfer, we will send you our bank details via email on receipt of your order and proceed to deliver your software once payment has been received.
Delivery Schedule
All of our software is delivered electronically, usually via a download link, delivered by email that will allow you to download the software installation file to your local PC or network. Once you have downloaded the installation file, simply double-click it to begin installation and then follow the installation process. You may choose to adjust any suggested settings during the process but we recommend that the default values be used unless you understand the implications of changing them.
Activation of the software works in one of two ways, depending on the product purchased:
1) In most cases, once you have installed the software and run it for the first time, you will be given a 16-digit 'submit' code on screen. Send that to us and we will send back a corresponding activation code as soon as possible (usually the same day). Enter this code in the box provided on the same screen as the submit code and your software will be fully activated.
2) In some cases (including but not restricted to our Soapbox product) no activation code is required. Simply provide us with your site key (generated during setup) and we will remove any trial restrictions via our server application.

Returns Policy
Most of our software is available as a free trial which enables you to assess the product and its suitability for your requirements. Because the software, in many cases, can provide an immediate benefit, the reversal of which we are unable to enforce, once you purchase any software, and we issue you with a full activation code, the software cannot be returned or refunded. It is the customer's responsibility to ensure that the software is suitable by use of the free trial version which can be downloaded from each of the product pages. For any software application for which no free trial is available, we will issue a refund within 30 days of placing an order, if we are satisfied that the software could not reasonably have been used to achieve the benefits set out in the product description. If you have any queries about the operation of any of our software, we will be more than happy to discuss this prior to purchase.
For any software which is supplied on a 'subscription' basis, and is charged monthly, the subscription can be terminated by 30 days notice in writing (email is sufficient). Any calendar month for which the service was available will be charged in full.
These terms apply to your order. We may change our terms and conditions at any time, so please do not assume that the same terms will apply in the future.
None of these terms affect your legal rights and these are not diminished in any way. If any term is held to be invalid under any applicable statute or rule of law, that term is automatically omitted from the terms to minimum extent necessary to comply with the law and without affecting the validity or enforceability of the remainder.
Remittance Terms
All software available from Codepath Ltd. is intended for use with the current, or in some cases older versions, at the time of purchase, of the Microsoft Windows operating system, the Sellerdeck e-commerce solution and the major web browsers (where applicable). Whilst it has always been our normal practice to continually develop our software to keep pace with newer versions of the aforementioned software products as they are released, and is our intention to continue to do so in the future, we may, at our sole discretion, choose not to do so with any or all of our products without notice or liability.
While we strive to deliver error free software, by accepting this agreement, the customer also assumes all responsibility to ensure that all data is securely backed-up so as to facilitate restoration to a 'last known good' environment if necessary and to perform a sufficient level of testing to validate that the software is performing as required after each installation.
UNDER NO CIRCUMSTANCES AND UNDER NO LEGAL THEORY, TORT, CONTRACT, STRICT LIABILITY, OR OTHERWISE, SHALL CODEPATH OR ITS LICENSORS, SUPPLIERS OR RESELLERS BE LIABLE TO YOU OR ANY OTHER PERSON FOR ANY INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES OF ANY CHARACTER INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOST PROFITS, LOSS OF GOODWILL, WORK STOPPAGE, COMPUTER FAILURE OR MALFUNCTION, OR ANY AND ALL OTHER COMMERCIAL DAMAGES OR LOSSES. IN NO EVENT WILL CODEPATH BE LIABLE FOR ANY DAMAGES IN EXCESS OF CODEPATH'S LIST PRICE FOR A LICENSE TO THE SOFTWARE, EVEN IF CODEPATH SHALL HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGES, OR FOR ANY CLAIM BY ANY OTHER PARTY.
